EEA4 Divorce application Complication. Help!

Married in 2003. Got 5 years July 2005. Got problem with wife and she wouldn't help me to apply for PR. Initiated divorce in May 2009. Submitted my EEA4 application on my own and informed HO that I have initiated divorce. My application was returned in July 2009 with a request to produce Decree Absolute.

I got decree absolute in Jan 2010 and resubmitted application mid Jan 2010 with proof of ex working docs for 5 years. Payslips, p60, bills etc.


My problem now is that my current employer has demanded that I produce evidence of my right to continue to work in the UK as my current permits ran out July 2009. I told them that my application is pending with the HO and I am still allow to work until the application is decided. They insist that I should produce a letter from HO within 3 weeks on else my employment would be terminated(I am a contractor).

I called the HO and they said that my application has been returned again for more docs. I am yet to receive the returned application but the HO said that since my application has not been accepted by them yet, I am not allowed to work.

I have always thought that you are allowed to work while your application is pending.

Please advise!

Hi,
If i understand the UKBA correctly, it seems they want you to produce your ex documents right up until decree absolute, thus Jan 2010.Was that what you sent to them togather with the decree absolute the second time you resubmitted your application?.As for the UKBA saying you are not allowed to work i am confused since i know you are until an application has been decided.I wish you are the best

Yes! That's what I sent to them. The D/A and 5 yr proof of my ex's residence / treaty. But they claim they have sent back the applications, probably for more docs.

I am confused too. They claimed that since the application has been returned to me, my application is not pending and since the 5 yr stamp on my passport had expired, I do'nt have a right to work. I am baffled!
