EEA refusal

My EEa was refused based on my not providing a form of indification(at the time ,my passport was lost and i was being processed for a new passport)
Now i have received my passport and have sent to it to the home office.
My question is in two fold.
1.While it is being reconsidered by the home office,do i still have the right to be in this country?
2.should i make a fresh application while am still in this country?
Ur opinions will be greatly appreciated.

Firstly:

1. Are you a EU or non-EU national?

2. On what basis are you in the UK/did you apply for a residence card or registration certificate?

3. Did you include a cover letter/update when sending your new passport to the HO?

If you answered "No" to point 3, then a fresh application + fresh docs may have been the sensible thing to do simply because your initial application was refused.

Opa46, would it not have made more sense to continue in your original thread, as you're still on about the same?

Right - piecing together all the bits.....

1. You arrived here on a visit visa

2. You made an EEA2 application for you and your deppendant brother

Questions;

1. What nationality are you and your brother?

2. How are you exersicing a treaty right in order to make an EEA2 application?

Thx for the prompt responses.maybe a history of the case may be more appropriate.
i came into the united kingdom and my brother (eea national)files an EEA DEPENDANT APPLICATION.After a year or so, the HO wrote back requesting my passport.in between the waitng period, i had lost my passport and applied for a replacement one.It has not been issued when i got the letter from HO refuseing the application without any appeal rights.
i received my passport a week later and sent it back to the HO for reconsideration.
My question still remain same
1.While it still being reconsidered by the home office,am i still legal in the country
2.Do i make a new/fresh application
3.What are my best options
