NON-EU MOVING OUT OF THE UK TO EUROPE WITH A BC PARTNER

My Story

I have been in the UK for 5 years (no leave to remain), I have a BC partner and a 10 months old BC son, we have lived together for almost 2 years (20 months precisely and have all documentary evidence). Spouse visa is not for me as my partner is still under 21. I have made a DL application on access right to my son and my article 8 rights (outside the rules). We have applied for a COA as well, as we are planning to get married before the end of the year in the UK.

I have heard of, and read about moving somewhere else in EUROPE, rather than wait for a DL and appeal and further appeals (if refused). We had a discussion on moving abroad which my partner actually fell in love with and we have SPAIN, GERMANY, SWITZERLAND and AUSTRIA in mind. Austria and Spain was my idea as I have cousins in Austria and a friend in Spain. Germany and Switzerland were random.

MY QUESTIONS

1. Given the fact that I'm still in the UK without a leave to remain, what are my chances of leaving the UK easily with my partner to seek work elsewhere in the EU?

2. Do we all need to return to my home country and move from there, with me applying for entry clearance/RC?

3. What are our chances/requirements of returning to the UK after, say a year or two?

4. Information on such moves in terms of cost, housing, employment oppurtunities and general living standards?

5. Anyone on this forum with such experience?

I would appreciate any helpful information and ideas, as this is something we are looking forward to and really wanna give it a go after getting married. Looking forward to hear from all the experience members of this forum

Spain, Germany and Switzerland don't recognise unmarried partners in their national law so can't when incorporating the EU directive, so u;d need to be married. Probably Austria too, Kuche, Kirche, Kinder and all that...

Spain I read they don't, Germany definately don't (cos we tried!) CH is flexible depending on length of provable relationship, six years to start but you existing status would go against you. Austria probably like Germany, only been once and it was like a more staid Germany!

Thanks Wanderer for your response. We discussed more about it today and realised that language could be a barrier in Spain, Germany and Austria.

We have decided on Dublin (Ireland) as a prefered option. I 've also got a few friends as well living in Dublin who can help us settle quickly.

Like I said in my first post, we've got a pending COA application which is already 6 weeks today. We planned to get married in August before trying this EU journey.

My question is how to go down to Dublin, do I need to return home with my family and all of us travel from there with me applying for an entry visa or RC? or given my irregular status in the UK, can we all travel from the UK without any problem (my passport is still with the HO as well)
