hi everybody,i'm non eea national married to eea national who was exercing her treaty right for 5 years,she is going to apply for PR next week and i reach this status one year after her,my question which i can find answer is
after my wife get her PR which documents i have to show the home office
when i apply for PR

letter from HO confirme that my wife has acquire the PR and documents show that i was with her in uk for 5 years(no need to show that my wife exerce her treaty right after she get her PR)or i still need to show my wife exerce her treaty right after she get her PR.

hi plum70,that's the probleme..
as far as my understanding to eea4 application, I have to show that my wife had exerced her treaty right in the past for 5 years.
it means doesn't matter how far this 5 years were completed before I apply for PR (one day,one month or one year is irrelevant to a dicision)
corect me if i'm wrong,if i show that my wife has acquire PR in the past and i was with her in uk 5 years i'm eligible to apply for PR.

Your wife has to show that she has been exercising treaty rights for 5 years up till when you qualify for PR.

So, hypothetically, if you are to attain PR in 2014 then your wife needs to show proof of treaty rights from 2009 - 2014.

my wife an eea national who has secured PR last month,and i'm (non eea) going to apply for PR after 1 year half,I wondering if i need her documents that show she was exercing her treaty right for the last 5 years.

Reda, you do not need evidence the EEA national has been exercising treaty right, if the person has right of permanent residence.

All you need to show is evidence that they are someone who has secured a right of permanent residence, and evidence you have been in the UK with that person for a period of 5 years.

A letter attesting that you spouse has secured Permanent Residence Certificate and evidence you have been in the UK for 5 years should do.
