Does the 1year visa EEA family permit count for HO as reside

Hi all,

Recently we applied for PR through EEA3 & 4(for my wife) and we are still waiting from HO.

My wife came the same time as me in UK, in September 2004 –on 1 year visa EEA family permit (spouse).After 1 year (Sept 2005) she applied for RC (until Sep 2010).

My question is:
When she can acquired her 5 year residency in UK, to gain her automatically PR card; I mean does her 1 year visa EEA family permit count for HO as residential qualifying period or when she got her RC- Sept 2005?
This info is also important for as to know that -when she is eligible to apply for BC ?

We appreciate if somebody can clarify that or have been in the same situation

The clock starts ticking once you are married. So if you were married and came to the UK in 2004 then you should have had your PR in 2009. So the 1 year will count towards calculationg the date for PR.

Eligibility for permanent residence
The following are eligible under Regulation 15 of the Immigration (EEA) Regulations 2006:
•EEA nationals who have resided in the UK (in accordance with the Regulations) for a continuous period of 5 years;
•Non-EEA national family members who have resided in the UK (in accordance with the Regulations) for a continuous period of 5 years;
•A worker or self-employed person who has ceased activity;
•The family member of a worker or self-employed person who has ceased activity;
