EEA residency and seperation/divorce

Hi,
I am a eea citizen and brought my ghanaian husband( married 07) here on a eea family permit in june 08. We separated in sep 08. And we stayed separated for one yr. During that year i had a baby.
he moved back into our home in sep 09, but only lived there for 6 week before leaving and disappearing. I have not seen or heard from him since.
His residency permit expires in 2014. we have a child who i currently have a residency order for through the scottish court. As he had just disappeared.
We are not divorced as according to scottish law we need to be seperated for 1 year with consent and 2 years with out consent. As i cant get consent i need to wait until nov 2011 as thats when we separated finally and i have a sworn affidavit on this.
He does not currently see his son. I assume he is in london somewhere. And court has granted me a residency order for our son.
What will happen to his permit when it expires? Do i need to notify the HO?
And will he be able to stay after 2014?
I have not worked since sep 08. I went onto maternity allowance in march 09 then onto ESA in nov and from that to JSA incomebased in feb until now.
I will be greatful for any help to know what will happen to him.
