EEA4, no insurance for first 6 month

Hi everyone.

Have a small question.

I’m non-EU family member of EU citizen. My wife and I came to the UK in March 2006. I’ve found a job next week, my wife just in about 5.5 month after we came in (beginning of September 2006). I called HO asking if it’s ok to apply for PR (EEA4) next March 2011. They said I have to submit an application 5 years from the day my wife “exercised the treaty rightsâ€

I don't think you can apply in march because your wife wasn't exercising treaty rights or having insurance. I don't see it a problem if you just wait 6 months. You have been waiting for 5 years already!

Was your wife a jobseeker in the initial period? Can she prove it? Was she registered with the job centre?

Funny....

Phoned to HO today.

The lady with a nice voice told me that if my wife has been a job-seeker for 6 month and didn't claim job seeker allowance means she was self-sufficient thus she had to have Comprehensive Health Insurance....

that doesn't make sense...we didn't claim the money because I was working at that time and we didn't think we actually can get them....

The lady with the nice voice needs to read provisions 6, 13 and chapter 1 (point 3.1.1) of the ECIS as you said that your wife was really registered with the job centre.
