Applying for residence card after EEA is expired

Hi All

I am slovak citizen, living in the Uk and my husband is tunisian. He arrived in uk end of August on EEA FAmily permit.
As i will have completed my 12 months under WRS next april 2011, he cant apply for a residence card yet. i understand he can apply for resid.stamp, but by the time he gets the stamp, he will be eligible to apply for the resid.card.
is it possible for us to wait until next april to apply ?
Also, his eea family permit expires next february. would that be a problem when applying for the resid. card?
i understand as long as i work here and am registered with WRS, he is here legally , so it should not be a problem, but im not sure of this.
Can anyone help please?

He will be perfectly legal without FMRS, residence card or EEA family permit but keep in mind that processing times are measured in months.

All i am worried about is that we apply in April and they will reject his application with excuse like , he should have applied for FMRS or smthing else, basically he should have done smthing earlier and he cant apply anymore....
I have called the HO and was advised he will be able to apply...but dont know it thats accurate.

I do understand it takes 6months or over but right now there is nothing we can do just wait as i have not completed my 12 months WRS yet.

They will not make such excuses because FMRS is optional as you can see from their official web page. Also, WRS will phase out in May 2011.

in that case i will wait till april and reapply then ( as we have applied a month ago but were rejected due to me not having completed my 12 months)
hope there will be no excuse like : his eea family permit is expired...
