when can i apply for my PR !!! please help

hey everyone i am just gonna cute my story short .
i came to uk in july 2004 ( visitor visa ) i over stay , i got married with EEA National and they give me 5 years resident visa on aug 2007. it will end in aug 2012 . me and my wife we about to get divorce well i have everything to prove that she was working and we live together so far . can i apply for my PR just after we divorce !! because i been in the country for more than 5 years or do i have 2 wait till aug 2012 !!

Stick to the Original Thread .

As Casa and Vinny originally advised, you are not entitled to PR, as you have not resided lawfully in the UK under the directive for 5 years, neither have you lived and married the EEA national exercising treaty rights in the UK for 5 years.

Under certain circumstance, you might be able to retain your right of residence, but in order to secure Permanent residence, you will be required to have been lawfully in the UK for 5 years, as stated in the Case law the Vinny provided.
