Leave to remain refused we need appeal of it. i need help no

Hi yesterday Home office refused my partner and my application for EEA2 reson was that we are not together for 2 years. we are as a couple for 1 year because my partner got 2 years visa and its expire in march 2011. we have a right to appeal and we will do it but i need a help with it. i can say that my 4 years old son loves him alot and thanks to him our life is better now.he isnt working as ho said he is not allowed so we follow all the decisions, what to do? how to fight?

The home office have made a legally correct decision based on what you've told us - so an appeal is unlikely to succeed.

Has your partner recieved his decree absolute yet?

but still can do appeal and see what they will say..no he hasnt got his final divorce and still waiting for it.
what will happen if he must back to morocco and his divorce isnt in final, can he back to me?

so I have another idea as well coz if i will go to my consulate to apply for visa for him will they issue it? if he cant stay in uk we will go to my country

An applicant will be granted a visa if he/she meets the specific requirements prescribed for the (visa) category in question.

So, the answer to your query depends on whether he qualifies for a visa as per the laws of your country?
