what does "Exercising Treaty Rights" really mean?

I am currently in the UK on an EEA Family Permit, and am applying for my Residence Card. My fiance supposedly must be exercising his treaty rights, and I'm not sure what that means- he does not have a national insurance number because his US-based company is still paying him in the US. Can I therefore not get the residence card?

Thank you! It still doesnt say, though, if the qualified person has to be being paid in the UK....

because there is no such requirement. The only real requirement is that you are not relying on
public funds (taxpayers money) in the UK.
