Please i need an accurate answer to my question,il appreciate if there is any proof to justify the answer.
can someone deported from a member state as a failed asylum seeker re-apply under the Eu law to join his kids and wife who is now exercising her right in another member state?
Thanks

Yes, that is possible.
But be prepared that there could be a serious suspicion that the marriage is a marriage of convenience, especially if the asylum-seeker married after fleeing his country of origin.
It can also be refused on grounds of public policy, public security or public health, but failed asylum-seekers are not normally in these categories.

Thanks for the info just only wanted to know if the negative immigration history can affect applying for a an EEA permit.
As for the marriage of convenience part.there are two kids involved and bonafide evidence to prove the non-eu spouse's dependency on the Eu National,
Once again thanks
I appreciate
