Need to go out while application is in process for EEA2

hi i had applied for EEA2 as a spouse of a Norwegian recently which i guess, usually take upto 6 month to be decided which will be due to complete in sep. my nationality is Pakistan and i just came to know that my mother want to go for some health operation in summer i.e around mid of june. is it possible to travel while my application is remain in process?? if i request them for the passport they will send it back without withdrawer of the application?? leme mention here that my wife will go with me n will be with me when i will come back..
please help guys. with some solid solution!!!

No, you cannot.
2 options:
- if you still have a valid visa - withdraw your application, do the business in your country, return and re-apply
- if your visa has already expired, but you do need to go, withdraw the application, do your business and apply for an EEA Family Permit from your country

There is
no need to withdraw the application. The passport
can be asked to be returned. A valid entrance clearance will be necessary though.

You can always request for your passport back without affecting your application. However if u do not have a valid visa than it's going to be hard to travel back into the UK.
Do you hold any other UK visa and not expired?

Thanx guys.. Yeah i do hold a student visa which is due to expire in dec. But obviously after getting my COA m working full time. As i am permit to do. Secondly i had stoped attending a college. So is it gonna effect?

The UKBA may believe that your EEA application voided any other leave to remain but read
here for some more details.

That's very strange for IMMIGRATION LAWYER to say that the application must be withdrawn. One would expect a lawyer to know at least what's written on the UKBA page!

Maybe I should have added the following. The student visa should be good enough to get you on the plane to the UK. But you may have a problem with the immigration officer. The least you would need to do is to carefully explain your situation and bring relevant information regards your application (CoA, work/residence related documents from your spouse). Theoretically that should work but you may be on the mercy of the IO's view on things.
