How long for re-entry? Quickly please!!!

Hi guys,

I beg you don't just read and move on. Please make some reasonable suggestion at least.

I'm was illegally brought in to UK (a teenager- almost 10yrs ago) by my dad and step mum but got kick out the house in 2005 and since been taking care of myself, with the help of friends, aunt and without recourse to public fund (very hard time). 

I was 15 at the time, got enrolled into college before I was kicked out and kept attending college (no other record of me before college in this country). I didn't tell anyone about my immigration status as I don't want to be deported so I continued studying until jun 09 when I can't go to Uni because I don't have a passport or status. 

I got arrested for immigration offence in nov 09 and since been signing-on weekly, applied for CoA to marry Jan 10, issued a year letter and since been married to French national.

I had a child in 2008  with my ex gf (British) whom I don't have anything to do with other than the welfare of my child.

I have recently applied for residence card but my application was returned and they requested I reapply with a passport when I get one.

 I've since tried to get a passport and it look ever likely I won't get one as the embassy asked me to get a police report (regardless of the situation) if I want a passport  even though I never had a passport in the first place. 

I went to the police station an asked for a report of lost passport and was asked to produce the photocopy or go back to the embassy to get a passport number which is impossible because I never had one. Now I can't get a passport because I don't have a police report.

I'm fed up of this and want to return to my country to apply for passport and re-entry but my wife won't agree with the idea. I can't even go to back to my country because I still need a police report to apply emergency travel certificate.

Now I can't get a passport here and I can go to my country. What do you reckon I may do? Is ukba oblige to proceed with my application in this circumstance if I re-apply? Getting a passport in my country will take 2 days maximum but the problem is, how long is it likely to take the british embassy to issue residence card from Nigeria in the case I somehow return home?
