after 5 years EEA family permit as partner.

Hi I am non EEA nationality, currently have 5 years EEA family permit since 2007. I got this after two years living with EEA pertner.

I phoned UKBA, EEA section, asked advice what to do.

I was told there are two options,
apply with EEA 2 for 5 years permit again.
OR
apply with EEA 4 for 10 years EEA permanent residence.but some rules are there, have to read the guideline.

any how, I will recieve visa stated EEA.
Because we are not married, if my relationship finishes, I have to leave UK. but I am hear since I was a student and now I am working, I have been here almost 9 years.

HOWEVER, MY RELATIONSHIP WITH PARTNER IS NOT SECURE, I WOULD LIKE TO GET INDIFINATE TO LEAVE AS UK RESICENCE, NOT AS EEA.
IS THERE ANYWAY, I CAN GET UK RESIDENCE? like other applications, take English in the UK and pay the fee.

really need some advice.

Just to clarify the second option - EEA Permanent Residence status is not valid to 10 years. It is the confirmation sticker that is valid for 10 year. The EEA PR status is similar to UK ILR status and is valid as long as you don't leave the UK for more than 2 years. Once you have achieved PR status, you are not dependant on your EEA partner any more for future applications.

As the UKBA told you, when applying for EEA PR using EEA4 it is important that your EEA partner has exercised treaty rights for continuous 5 years. Read the guide for more information.
