Non EEA national and a Latvian wife

Hi,
My friend is on a student visa in UK.
Last month he married a Latvian National Girl.
Now he needs to know, can he apply for Residence Card as spouse of EU National.
His Tier 4 leave will expire in End of July. If he apply after that, will he be classed as an over stayer. If so what should he do.

He doesn't need to apply for anything. As long as EEA National is exercising treaty rights in the UK, your friend can legally live and work in the UK. Of course, life is easier with a Residence Card, see

Is your friend's Latvian wife working or studying..or is she 'self-sufficient' with private medical insurance?

No. She is not working, studying and she is not self sufficient either

Then she (and her husband after July) obviously has no legal basis to stay in the UK. A residence card application will also fail under these circumstance.
