hi everyone
i read many topics about getting family permit, but didnt found anything simillar to my case.

My husband recently got hungarian passport, we both live in serbia.
He has residence in serbia. Will that cause a problem, because he has not residence in hungary?

And further:
We are married for 2,5 years, living together for 3 years
We planned soon to apply for my FP in serbian world bridge office, but we have several issues:
1. We are both unemployed
2. We have only a few photos together (including wedding photos)
3. We dont have ANY proof of living together, first we lived in rented appartment, but bills was on owners name, we are not related to him. For last one year we live in his parents house
5. We dont have joint bank account

I read that we only need his passport, marriage certificate and a letter-if we state staying less than 6months, but seems that everybody show more (at least bank account). What if they refuse my application? And if we make an appeal, with our few documents, seems perfect for another refusal :)
and one more thing: i applied last year for tourist visa, my parent lives in the uk, but didnt get it, at that time i was also unemployed, that were the reason for rejection. That was my third tourist visa, the first two granted without problems.
Suppose i must put that in application, i have a stamp in my passport.

His current residence is of no importance. A marriage of 2.5 years should not lead to questioning the genuineness of the marriage and therefore providing only the marriage certificate should be sufficient. Your list of required documents is correct regardless of how long you plan to stay. Re-application and appeals are possible but keep in mind that a 'full' appeal could set you back for many months. If the VAF5 form asks for previous visa refusals you have to put that down but it can not have any bearing on the decision.

It does not matter how much money you have or whether you are employed. And as 86ti pointed out, you have been married for a long time: the marriage certificate alone is all that is needed.

Are you planning to move to the UK, or just visit? (Not that it matters).

And you should not be charged ANY fee for the application!

yes, i read that you hundered times repeat that is no need for bank statements, tenancy agreement, job etc etc...
But i am worried because i read also hundered times that ECOs refused family permit with no legaly reason...
And if i deal with some ECO who is not in a mood, it is not a satisfaction that know that i am right and he is not...
And than what, to re-apply or make an appeal...
We plan to settle in the uk, and we now have a chance, i hope
but (in application) i will state 2 months as you always advice

If denied your first contact would be the entrance clearance manager (ECM) whose address you should be able to find on the embassy web page. The ECM can overturn the refusal. This could take a few weeks. Search the forum for such successful complaints. You can also complain directly to the UKBA if you feel the embassy is not dealing correctly with you case. As this is an application under EEA regulations you can also complain to SOLVIT eventually.

You do not have to say how long you want to stay just as you do not have to answer most of the questions.

Those questions are sometimes valid for some very obscure situations. So if it was not your husband/wife (which is very mainstream), but instead it was the brother who used to live with you...

But still, as i read on this forum, 90percent people who were in same situation like me (most common case-spouse), gave almost every paper and every answer (asked in application).

There was one person who apparently submitted almost 2kg is supporting material. If you are going to go over the top, might as well do it in style! My suggestion was that they also include all of their supermarket receipts for the duration of their marriage.

urghhh... I am so jealous of them!
