For EEA family permit & EEA2

hi alll,



i am newbie to this forum but lately i have been reading all the posts so i thought to get all of your help regarding my issue


i m doctor from pakistan and my wife is french national and now we are planning to move to uk

my wife had her education Mphil biotech from pakistan.

and presently i m in saudi arabia doing a job here... now we are planning to move firstly on EEA FP and then once there in uk we are planning to search for a job and apply for EEA1 & EEA2 both

but the problem would be are we both much freshh for EEA1 or EEA2 to apply means with a job for like 4-5months if we get there in uk be enuff to apply for RC or we can apply for

Welcome to this forum!

The key person in all this is your wife (the EU citizen). You get to come along when she decides to move to the UK... http://eumovement.wordpress.com/2011/05 ... a-citizen/

She does not require a job in the UK before the move or initially. Once she gets to the UK, for the first 90 days there is nothing particularly she needs to do. If she wants to stay for longer, then she will need to work or have enough money to be "self sufficient".

As long as she is meeting those requirements, you can be in the UK and work or study or ....

To get the EEA FP, you do not need to give information about what either of you are doing now or how much money you have or what you will be doing in the UK. See http://eumovement.wordpress.com/2007/04 ... u-citizen/

A side issue here is .... are you wanting to work as a doctor in the UK? If yes, have you investigated how to get authorisation to enable you to do that?

yah i want to work as a doctor and for that i have to give plab exam
but after that need right to work for training

I wondered, because you wrote needing to test the PLAB test, but as you will be a family member of an EEA Citizen exercising Treaty Rights in the UK, aren't you exempt from that?

As long as it is clear that your wife is exercising Treaty Rights in the UK, there is no reason for the applications on forms EEA1 and EEA2 to be rejected. By the way such applications are not compulsory, the rights come from the Treaty, but especially for you as a non-EEA family member, how do you prove you have that right? So effectively you need to make the EEA2 application, whereas your wife's French passport or her French ID card proves she has the right to be in the UK exercising Treaty Rights.

The EEA FP is valid for 6 months. So you have a bit longer with the original proof of your right to be in the UK

yah i know that i can be exempted from plab but if i apply for exemption it would take 3-4months of my FP. i would be left with 2-3months of job n after that have to apply for eea2


so dont know shld i give plab or apply for exemption. i think exemption would be easy route but wt abt work???

I think you are confusing the requirement. It is that the EEA National is exercising Treaty Rights, not you, and on the basis of your EEA spouse exercising those rights, so do you have such rights, as their family member.

yes john now i understand wt u mean to say but she is not currently in uk so she is not exercising her rights...in that case we should move to uk together n then she should apply for the job so she could exercise her rights and in that case i would be able to have the rights n thus job there???

Well yes, she clearly needs to move to the UK, but being employed, a Worker, is only one of the way she could exercise Treaty Rights. She could also be self-employed, a student, or a self-sufficient person.

You tell us "my wife had her education Mphil biotech from pakistan.", so clearly a well-skilled person. But, and you don't tell us, for all I know she is currently a housewife looking after young children? If that is the case, she could exercise Treaty Rights as a self-sufficient person.

yah she has Mphil biotech but she is currently writing her thesis but she applied for the many vacancies as Mphil Biotechnologist even as lab technician but didnt get any reply from anywhere.i think this could be due to she is not currently in uk or they dont consider Mphil Biotech from non-eu country
