Hi All,
I'm Italian citizen who arrived from Australia with my son born in Australia and my wife Australian citizen too.
My wife and my son arrived under a tourist visa and myself as a EEA member, with the intention to apply for a family members permit for my family.
2 months ago, my ex-wife has separated from me and left UK to go back to live in Australia living me with the child.
An Italian passport for my child is on process and should be ready within the next few days.
I'm working, rent a flat and have sufficient funds to care for him.
Can my child stay in UK with me ? Or will I have to go back to Italy with him ?

Your child can stay with you, of course. As it is an Italian citizen there are no further formalities required. You can apply for registration certificates for both of you but that's optional and, frankly, pretty useless in your situation IMHO.

I agree that your child should be fine. However if you choose to apply for a Registration Certificate to confirm his right of residence in the UK, the Home Office may require consent from the mother, that the child can stay with you.

Good look with bringing him up. You certainly deserve a medal, bringing up a child on your own in a foreign country and managing work life and child rearing life is certainly commendable.

The child should be no problem at all.

You should be aware that to stay long term (more than 3 months) in the UK, you need to be working or have enough resources to be considered self-sufficient.
