Permanent Resident EEA spouse and EEA2 application

Hi

My question is that can I apply to EEA2 when my spouse holds EEA4?

In the caseworker instructions and the application form, they are only mentioning the exercising treaty rights documents and registration certificate EEA1 if the EEA national has.

However, there is no information provided for permanent resident EEA nationals and their spouses applying to EEA2.

Even if my spouse has EEA4, can I still use EEA rules and apply for EEA2 or have to use immigration rules and apply as a spouse of a permanent resident person?

I guess you are referring to PR status confirmed by EEA3 application. EEA4 is for confirmation of PR for non-EEA nationals.

You can still use the EEA route. Just provide the blue card as evidence and if the card is more than 2 years old, evidence that that EEA national is still resident in the UK (as the PR is not valid if you leave the UK for more than 2 years).
