Suggestion Please..EEA2

I've finally managed to re-new my passport from my embassy (without a valid leave to remain i.e. overstayer for the past 3 years). I recently got married to an eu national Oct 2011(been together for a year), Now I'm about to apply for my EEA2 residence card next week(i.e w/c 07/11/2011). Can you please advise if I need to involve a solicitor as me being an overstayer?? or shall I just apply it directly. We got all the proof's, Pictures of our Big wedding, utility bills, all the other documents that furnishes we are living together etc etc. My wife she's already received her EEA1 back in July2011(it took nearly 2 weeks to come through)..
I'm pretty much confused??
Let me have your honest replies...

did you get marry here in the UK? If yes did they know that you were overstayer?
Now if you married somewhere out or even in.. Just be honest in your applicatioon form and better write a cover letter explaining your situation.
They won't put your application down.
solicitor is a waste of money.. better save it for holiday.

I got married in England they(HO) is likely to find out once they see my passport that I overstayed, or even then by my name and DOB most likely they will.............You sure they won't refuse my application just on the basis of that I overstayed my previous visa???
