Dear All,

I hope you are well. I have been with my girlfriend for about 1 year and half, we are both Phd students in the same university (UK university). We intend to get married but we are waiting for the completion of our PhD which is in about 2 years and a half. We do not live together. She is italian citizen and I am non EU. Is there any chance I could convert to partner visa?

if have not been living together for 2 years and are not married, then will not qualify as a partner of an EEA national under the EEA regulations.

Thank you for your quick reply. but the main condition to switch to partner visa is to live together for two years not to be married right?

'Partner visa' is the wrong terminology. Your partner is an EEA national and therefore if you wished to remain her on the basis of your relationship you would need to apply for a residence card under the EEA regulations as the family member of an EEA national. If you and your partner are neither married nor have been living together for 2 years then you would not be treated as the family member of an EEA national.

If you married then you would be a family member, however if after you married, you were still not living together they may question whether the marriage is one of convenience.
