Non EEA divorce/ student fees

Hi guys,
I have a question regarding student fees I should pay, whether home or international fees. My circumstances are as following:
Married to eea in august 2008.
Came to uk in february 2009.
Separated in november 2011.
Divorce initiated in january 2012 with decree absolute expected around march or april.
Course starting in february and ending in june.
Technically, i'm still a family member till decree absolute which means that I start the course as a family member and end it as a non family member. Anyway, I paid all fees today in advance as a home student.
My question is: is paying home fees regarded as access to public funds or not?
Is it going to affect my application for retention after the completion of divorce?
I believe for retention I submit lots of papers but none of them is required regarding education, did I get it right or not?
