Travelling on EEA family permit

Hi All,

A very quick question. I'm a dual Australian/Italian national and have taken out a EEA Family Permit for my de-facto partner of over 3 years. It is valid on her passport until 2016. We have resided in the UK since 2005.

We are looking to travel to Italy/Spain to visit family and also potentially to France to watch the Tour De France (I'm a keen cyclist!).

My question is, can she travel to the countries mentioned, always accompanied by me obviously, without having to take out a Schengan visa?

Is it dependant on individual EU country laws or does one EU Law supersede it all? Please provide me a link to relevant EU law if you have it handy?!!

Many thanks in advance!

John

I presume she has a 5 years Residence Card and not a Family Permit which is only valid for 6 months.

Perfect timing.

ca.funke just posted today a message that cover this topic exactly.

See IRL or UK to Schengen, without visa, for EEA-family members.

Hi, yes it says:

Type of Document: Residence Card of a family member of an EEA National.

Thanks for the link! Part 1 applies to us then!

Part 1: This only applies to you if
you are a family-member of an EEA-citizen AND
legally living inside the EU but outside Schengen (=UK, Ireland, Bulgaria, Romania and Cyprus) AND
You have been given a "Residence card of a family member of a Union citizen"

Thanks again and all the best, much appreciate the prompt reply!
