how does marriage date and r.c count?

Hi dear friends I'll like to ask if anyone know how does this PR for non-EEA works, coz i have been marriage for 8yrs but not in the UK but within EU country with my EEA national but moved to live in UK late last year with EEA FP. so my question is this how does the PR in the UK counts does it works with the date of the RC issued or from date of marriage? cheers!!!

Neither. In your case it's from the day you entered the UK as a married person so sometime late last year.
Time outside the UK (before you moved here) doesn't count. The date on the RC is not relevant as the RC is just a confirmation of your rights (applying for RC is optional).

Hi zubby007,
To be eligible for PR as a non EEA, you must have been resined(with your EEA spouse) in the UK for a minimum of 5 yrs and your EEA spouse been exercising treaty right throughout those 5 yrs.
I'm afraid you will have to complete this period.
All 5 yrs have to be proved by evidence(documents).

thank you guys for your kind advice, just to add to it my EEA spouse has been exercising treaty right in the UK for almost 5yrs we got documentation to prove that coz she moved to UK before me although i joined my spouse in 2008 but not on permanent one coz i'm always off and on coz of my work abroad at least i can count 5 EEA FP.in my passport so how does one count the 5yrs before PR? cheers!!!

You can count time with EEA FP but it all depends how long you been in the UK and how long abroad.
You are allowed to be upto 6 months (out of 12) away in order for the period to still be counted for PR. If you only came every few weeks to visit your wife over the weekend, this will not count.

I'm not so sure but if u have been out of UK for six month or less(once in 5 yrs) or out of UK for business purposes u might be ok but still has to be during 5 yrs of residency(which u said 2008) so I guess it's not 5 yrs yet,,,,
I hope im wrong and u qualify but,,,,,thats my knowledge.

That's helpful to know. I spend a lot of time out of the country for business purposes, so it's relieving to know that the time doesn't count as being absent! I'll be applying for my RC soon, and then once the time has passed will apply for PR!

Yes, but it's all depend on how long you spent outside UK in my own case My job was outside the UK.
