EEA2 RC and return of documents

Hi Forum,

If you have read my other posts you'll see that I entered with Non-Eea spouse at Calais on 14/12/2011 with no EEA FP,

Applied 22/12/2011 for RC but applied under Singh and didn't have a British passport only my Irish one, also didn't translate my evidence of exercising treaty rights which were all in Dutch!

So UKBA returned whole application towards end of January.

Arranged translations and a British passport for myself and reapplied on 06/03/2012, My spouse just got the COA with right to work on 26/03/2012

What I want to ask is what do I do about our documents and passports as they have not been returned and his passport is the only id my spouse has to enter employment and open a bank etc.

Is the general idea that UKBA hold onto all our documents and both our passports until the RC decision is made?

Indeed, that's the normal procedure.
However, you can ask for passports (and other documents perhaps as well) to be returned to you. That doesn't affect the procedure, but it may result in the RC being issued as a standalone A4 paper (immigration status document) instead of being put in the passport.
