ILR Continuation period query

Hi,
Many thanks for reading my query
I came to UK for the first time in april 2009 ( Tier2 - ICT visa valid dec 2010)and travelled back to India on Jan 2010. applied tier-1
with in 28 days, and got visa February 2010, then I come back to UK on April 2010 and been living in uk since then.
my query here.
Is it ok for tier 2 to tier-1 switch in India , but with in a continuation period times???
I resigned in India and come back in that time..??
please share your thought on this scenario???
