10 yrs Long residency, Lost 1st Passport

HI,
Can someone guide me about my two issue?
FACTS:
# I came in a UK on 06/12/2003.
# I have done my MSc degree on 2008
# My Tier 1 (General) application has been refused (with no apeal right) on 0ct 2011. I have lodge the judical review, then reconsideration request to HO and finally I hve got my "Discretionary Leave" from 1st Tribunal on sep 2013.
Finally I am going to apply ILR on long residency bassis. I have loss my 1st passport between HO and Pak Embassy during 2011- 2013. I have letter from HO where stated they sent my PP to Pak Emabssy but Pak Embassy doesnt have clue 4 my passport.
Questions:
1. From 10/2011 to 09/2013, HO and court , dealing my case but I initally I didnt get apeal reight . Is HO consider that time into long residency or NOT?????
2. My 1st PP (2003-2006) will create a prb in my application ?? I have lot of evidences 2 prove this duration such as HO Immigration history letter , 1st NHS registration Letter, NI Letter, Electrol Registraion letter. (all of them belonging wid same duration).
Plz guide me.
