Does a already licencensed non-eu dirver have to exchange?

Or apply for a UK licence, on both accounts the DVLA says that applicants have to have leave to remain, does spouse visa mean leave to remain? My husband recently got his spouse visa, he is in the process of getting a UK porvisional do the tests and apply for a licence, can he even get on with this wording on teh dvla in place?

Use the 'exchange driving licence' interactive tool
Whether a resident can exchange or not depends on the person's current valid driving licence (issuing country), and not on the person's immigration status.

I ask because of the wording used on the forms, it uses leave to remain which is very confusing.

Well it seems that while the law allows drivers to use their foreing licences, insurance does not want to insure!! such crap.
