Tier 1 to indefinite leave to remain in uk query

Hi, I am currently on tier 1 visa and my 5 years are completing this sep (2012)
but i had to move back to India for contineous 4 months in 2009 ( from june 2009 to sep 2009) after which I came back to uk in sep 2009

am I eligible for pr (indefinite leave to remain) in sep 2012 beacuse of my break?
I am not very clear on the policy for max number of days we can remain outside of uk within 5 years.

Can someone please suggest on this?

The maximum number of days allowed outside the UK within the 5 year qualifying period is 180, of which thee should not be any single gap of more than 90 days. The following is the guidance on this

You do however have the option of explaining the circumstanses due to which you had to remain out of the country and this could be taken into account. It would be best to speak to a solicitor about this. [/url]
