ILR eligibility - 5 days short for continuous 5 years period

My previous company in UK sponsored 5 years work permit

Old work permit Visa details: 10 may 2007 to 10 may 2012 (visa stamped at cryodon home office on 10 may 2007)

On may 2009 at Cryodon home office , I changed my visa to Tier 1 general

Present Tier 1 general Visa details: 5 may 2009 - 5 may 2012

I would like to apply for the ILR in next month .. However I found that shortage of 5 days for continuous 5 years period for ILR ..
Please advice..

The five days will not matter as you can apply for ILR 28 days before the end of your qualifying residence period. However, you have not given the date when you entered the UK or were granted leave to remain under WP. That date is the start of the residence period and you must count from then.
