Dependents under GTV

Hi,

I am wondering if anybody can help me. Is it possible for a GTV dependant (wife) to combine time as a dependant on Tier 4 student visa and the 3 years spent on GTV dependent to complete the 5 years required to apply for dependent ILR (the main applicant got ILR).

Yes, it is possible to combine time as a GTV dependant with any other type of dependant visa. That's covered in the immigration rules.

Hi, Lolo2. Thank you for your reply. Do you know anybody who got ILR by combining GTV dependent and student visa dependant to meet the five-year requirement? I've just spoke with an immigration solicitor, and he advised me that my partner can't use the time spent as a dependant on my student visa, and she must be dependent on work visas for 5 years in order to be eligible for ILR as a dependent. He told me that if she applied now, her application would be refused, and she would have to reset the time, beginning from zero. This is quite disappointing as my wife's visa will expire next week, and I hoped she could apply for ILR using both dependant visas (GTV and student). Any help with this issue would be highly appreciated.

It is possible to combine time as a student dependant with GTV dependant for ILR. Your solicitor needs to revisit the UK immigration rules.

Some members have successfully done this and posted on the forum. Do a search here and on the ILR forum if you want reassurance.
