switching to Tier-1 exceptional

Please can i switch to tier-1 exceptional if i have an ongoing JR for my previous application for ILR.
What is your immigration history?
What is the reason for ILR refusal?
I think you need a valid visa and have to qualify to switch to Tier 1 Exc Talent.
