Tier 1 Exceptional Talent Dependent Query

Hi,

I am currently in UK on Tier 2 ICT long term visa, which was initially granted (entry clearance) June 2010 as tier 2 ICT -Established Staff, I also have my family including wife and 2 kids less than 18 years in UK as tier 2 dependents the current leave is valid till march 2021.

I have got endorsement for tier 1 Exceptional Talent visa and planning to do stage 2 application, I have some questions regarding dependents.. hope some of the experts here can provide me correct guidance.

1. Do I need to make dependents application at the same time as me. Or can I make my tier 1 Exceptional Talent application and at a later point (few months) do their application.

2. What documents do I need to submit for my dependents if I make application for tier 1 Exceptional Talent Dependent. If you could point me to the right guidance that would be great.

3. Is it mandatory to switch my dependents visa in my case? I am just asking because my dependents already have a valid leave till 2021 and to make a new application I would need to pay application and NHS surcharge,etc.

Hi,

I have one additional query on the application regarding 'declaration of driving offence on immigration form' . 15 months back I got an Fixed Penalty Notice (non-endorsable i.e. no points on my license) by the police for driving without seatbelt.. I was subsequently asked to take an online course instead which I did in time and so I dint have to pay the penalty.

As there is an question in Immigration application:
7.6 Do you have or have you ever had any of the following, in the UK or in a different country?
• a penalty for a driving offence, eg disqualification for speeding or no insurance

Should I declare Fixed Penalty notice that I got. Please let me know if anyone else had similar situation and how was that being dealt.

Hi, Posting my experience on what I did eventually. Might help others who are in similar situation as mine. 

1. It is possible to do in-country T1 ET Stage 2 application for main applicant first and once you get your visa - your dependent can then apply. In my case I did all together (Main application + dependent) via Post. It took around 6-7 Weeks to get the BRP cards.

2. It was simple and straightforward.. Just the passport and my existing BRP card's + a copy of endorsement letter was required for STAGE 2 (along with filled in application - online). For dependent's just the passport and BRP card.. I included my dependents in my application. UK Home office gives you option while filling up the online application form.

3. It is mandatory for dependent to switch the Visa category if the main applicant is switching the visa in country.

4. Declared the FPN for driving offence on the application, and provided supporting documents.

Hi tier2ICT_ES,

Congrats on your ET visa. Just a couple of questions:

- How long did it take for HO to process your stage 2 ET visa? I am still expecting a decision on my stage 2 ET visa and its been 12 working days now. I am applying from outside the UK.
- Did you submit a bank statement as part of you stage 2 supporting docs? I submitted a bank statement and I am a bit worried that it is an unnecessary supporting doc as there is no official requirement for it.

Hi,

Applying outside the UK you need to wait 3 weeks. In some cases, Home Office gives the results on your application earlier. So, I suggest as of now you have already got your results (I saw your post is dated on Dec 27, 2017)

Regarding the bank statement, I wrote about the optional supporting documents in my blog about my Tier 1 ET Visa story - it is not required officially. However, in my case, I applied it just to be sure and show my financial abilities. By the way, I got a positive results after applying this extra doc, so do not think too much about this issue.

I received the the email from UKVI on the 15 working day and on the next next I collected my passport with vignette and BRP decision letter. I was worried about the bank statements because I submitted NATWEST electronic letter headed bank statements which I downloaded online without any stamp or letter from bank. But everything was fine.
