Tier 2 + Tier 1 (Exceptional Talent) eligibility for ILR

Post by shrikantK » Fri Apr 03, 2020 5:06 pm

Dear All,

I completed 21 months on Tier 2 (General Visa) & then switched to Tier 1 (Exceptional Talent) visa 8 months back (in July 2019). So in total I complete 29 months on T2+T1. (My present T1 expires in 2023 - well after I complete 5 years eligibility period for ILR).

But from somewhere I learned that since the introduction of Global Talent Visa (20th Feb 2020), ILR Mandatory stay periods come down to 3 years for Global Talent as well as T1 (ET). Is it true ?

If yes, then I should be eligible to apply for ILR soon after completing my 36 months (21 on T2 + 15 on T1).

Please let me know if these new rules also apply to old T1 (ET) holders?

Thank you.

Hello CR001, That link was very useful, thank you for sharing.

I learned that I am eligible to apply once I complete 36 months (19 on T2 + 17 on T1). So now I have at least 2 years of spare T1 visa.
Wondering will I be able to refund my IHS payments from UKVI for that remaining time?

And any idea about ILR for dependents? My wife is dependent on my visa since the beginning.

Thank you once again.

You dont get an ihs refund if you apply for ilr.

https://www.gov.uk/healthcare-immigrati ... on/refunds
You will not get a refund if:

your visa application is successful but you do not come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain or changing to another visa where you do not need to pay the IHS
Your dependents need 5 years residence on PBS dependent visa before they can apply for ilr. There is no shortcut route for them.
