Spouse visa/Carer's allowance-Complicated location situation

Post by Ayush12 » Wed Nov 20, 2013 11:36 am

Hi everyone,

I've been reading around this forum for awhile and found some great advice being passed around!

I have my own case that has wore a hole in my head literally (Iam losing hair!) because I don't know what the right course of action for me is.

I am a British citizen who is married to a non EEA who currently lives in Holland. He has been refused asylum in Holland, but has no where else to go.

We got married 2011 and have lived in Holland with him working while he waited for a response from the Dutch immigration. Last year he received his refusal/negative. We'd planned I would work and appeal against the decision but I got pregnant and left to for the UK because we were struggling financially and we had no access to benefits.

I now have a 9month year old boy, work part-time as a nursery nurse and also receive care's allowance for my younger brother who has server learning disabilities- (my mother has had mental health breakdown and cannot take care of him).
I get Housing benefit/child benefit/child tax credit also.
I have some savings but not a lot. (4,000 pounds)

I am thinking of applying for the spouse visa for my husband, (He really has no access to anything in Holland, and has no financial aid- I've been sending him money where I could).

But I don't know if I qualify and I can't afford a lawyer to go through all the requirements.

From what I've read around the forum it would seem I am exempt from the financial requirements (18 thousand)- but how about the maintenance?
Can I add up my CA, wages and Housing benefit/council tax and meet the maintenance requirements?

Is the left-over amount different for me because I have a child?- I read some I must have a maintenance amount of 112,12 pw

My husband speaks English and has worked in Holland for 2 years before he got his negative. Is it possible for him to starting applying for work here or does he first need permission to enter?

He is also in Holland with a negative, can we still apply?

As you can gather I'm rather sick and confused and stressed over this.

Thank you in advance.
