Spouse visa refused

Hi

I wanted some advise if anyone can help me.
My wife visa to UK from Bangladesh was refused, the refusal was asking her to retake the ESOL exam with City and Guilds.
She has taken the test again and waiting for the result which should be issued in December 2013. My wife is pregnant and will be 6months in December with our first child.
My question are
Once we receive the ESOL CERT, how long does BHC take to issue the visa or do we have to go threw the appeal process?(There was no other reason for refusal just told her to take the ESOL again)

Are pregnant females allowed to fly?

If she is granted visa in April 2014 and the baby is due in April 2014 would I need to apply for my wife again?

Normally women are not allowed to fly beyond 36 weeks. However, that number varies airline to airline. Beyond about 30 weeks - they'll normally need a letter confirming they are fit to fly from their doctor (my wife needed one at 24 weeks on Emirates).

You cannot appeal with new information. So if she takes the new test - she'll have to re-apply - with the associated wait time (n.b. an appeal might take longer!!!)

So - you might want to think about a couple of things:

1) What is your immigration status - this may affect the status of the baby - and thus what visas you need to apply for.

2) If there is a delay in issuing the visa, your wife may not be eligible to fly. So you would then have to apply for the child and wait for that.

3) Given your wife, if the visa is issued in a hurry, would be arriving in the VERY late stages of her pregnancy - you may wish to reconsider. Having been with my wife through 2 births, she would have hated giving birth in unfamiliar surroundings with doctors/midwives she didn't know - particularly if there were then any complications. You might be better off travelling to be with her for the birth.

But - having said all this - you may wish to post the text of your refusal here (the exact wording) so that we can assess it properly.

I am in the exact same position as yourself. My wife was refused visa due to her ESOl not being accepted as my wife completed her ESOL before October 2012 and there were irregularities in testing of City & Guilds in that period. She has redone at there request for free and we have appealed the decision and are currently in the appeal review period.

Can you tell me how you got on. Has she got her Visa yet, how long did it take. Any help would be much appreciated.
