DLR renewal

Post by Martha18 » Wed Dec 18, 2013 4:01 pm

I don't know if this is the right forum for it but my partner whom I have two British children with decided, after receiving his DLR visa earlier this year, that he would discontinue to care for our children and has since moved out, not made any effort to see his children and is now in another relationship. I initially supported his original application which he submitted on 7th July 2012 before new rules.
His visa is due for renewal in 2015, is he allowed to use somebody else to support this renewal? We had been living together for 3 years and had planned to get married, he now doesn't contact me or his children and is adamant that he will be getting away with it. Please help.

Because DLR is, in essence, leave outside the rules he can renew that leave if he can prove he still qualifies.

So if his circumstances have changed - he'll have to prove that his circumstances still allow him to retain his DLR.

Therefore - if his DLR was based on his relationship with you and the children and that is not now valid - he'll have to prove his NEW relationship also entitles him.

If I were you, and the relationship is unsalvagable, I'd follow the advice here: http://www.ukba.homeoffice.gov.uk/visas ... ship-ends/

Thank you for that information and advice. I will take to writing to home office about this as I am left with no other choice, he doesn't seem to care whether or not he has a relationship with his children, nor does he communicate this. And the manner in which he left suggested to me that he was already planning to up and leave soon as he got his visa. Thank you again.
