Tier 2 Partner visa and ILR

Hi,

I am on a tier 2 ICT visa planning to apply for ILR.

My wife who has lived in UK for 3 years on tier 2 partner visa is currently not in UK. If and after I get ILR, could she come into and live in UK on tier 2 partner visa? She will apply for ILR after coming back to UK

Due to some circumstances, she is unable to come into UK at the moment, and I don't want to delay my ILR applicaiton any further. I am eligible since Aug 2013.

I also wanted to ask if there are any rules around the period of absence for the tier 2 partner in regards to ILR application? She is away from the country since Oct, and will probably be back in Mar 2014.

I assume you will settle as a PBS applicant, your wife's leave would remain valid in such case. Her absences should be limited and for good reason.
