FLR (O)

Post by fadi88 » Thu Dec 26, 2013 12:58 am

I am immigrant who entered in UK on student visa in 2008 from
Pakistan, I have done BTECH HND Networking, then BSc (Hons) from Leeds
metropolitan university. After finishing my degree I have applied for
PSW visa on base of my degree. I have done PGCE in education and
qualified as lecturer in july 2013. during my psw i have had problem with police and on bad advice i have pleaded quilty for handling stolen good in 2012, my visa was finishing 2nd November, but I got married in Aug. 2013, on 31st October, I have applied for FLR(O) application on which I am waiting for decision to be made. for last few months I have started my own business again. But my partner is on benefits and shes pregnant now and delivery is due in may 2014. I just want some advice on my case. if I ever get rejected
what bases will be for my appeal? what I can do now to strengthen
my appeal if it ever gets rejected . thanks

Is your partner British? Are you getting married/registering a civil partnership?

You mean you accepted a caution?

Ex.1(b) (click) may be applicable for FLR(O) and when you have a British child ex.1(a) also. Also consider applying for spouse leave outside the UK if you meet the requirements.

yes i have accepted the caution.. and they fined me too . also my family isn't happy about my decision of marriage. as I have been married outside family n without permission of family. I have letters from my parents saying I got no part in family property and life in abroad. this I already mentioned in application and also I have included letter from my parent that they arnt responsible for any of my acts. so what do u think ? thanks

Without the child you'd have to show there are insurmountable obstacles to family life with that partner continuing outside the UK. However, the fact that a British child is en route should be the most supporting evidence.
