Tier 1 (General) - Spouse Visa from India

Post by tier1_PEO_applicant » Wed Feb 05, 2014 6:56 am

Dear All,

Firstly I have to be thankful to all those who've been great help to applicants like me on the site.

I am bit confused about the process and requirements of the Spouse visa for a Tier1 General immigrant, applying from outside UK.

I am currently on Tier 1 General visa, expiring in Nov 2015. And I have been in UK for last 10 years.

As I am getting married I am currently in India and planning to apply for my wife's visa(spouse visa) before travelling back(together hopefully) in May.

Now, just before flying to India this January, I was made redundant.

So could someone help me with few things below ??

1. What are the chances of my wife getting her spouse visa on application VAF10 if she gives details of me being redundant along with the previous job and the salary(40k+ annually) which I earned for last 3+ years ?

2. Together we have more than 20k+ in savings, and I have 20k+ in redundancy payout, though this hasn't been in account for 90 days.

3. We'll also be furnishing marriage certificate.

4. Would she need to show English efficiency? By clearing IELTS etc before applying for visa ?

5. When does she have to go for TB XRay ?? Is it after visa approval, or before applying for visa ?

6. Lastly am I correct in assuming that I need to show 900pounds for myself and 1800pounds for her as total maintenance money ?? Because I have been living in UK for more than 12 months
OR
Do I have to show 1800pounds for myself and 1800pounds for her as I am currently in India though, I've lived in UK for more than 12 months ???

And I did try finding these answers in the forums but couldn't get much success as most people have been discussing queries relating to applications within UK.

Thanks to all in advance.

AFAIK you don't need to be employed to apply for your dependent visa. You just have to provide document to show that the maintenance funds of £1800 are in your account or her account and provide proof your marriage and that your relationship is subsisting. Do provide as much evidence as you can to prove the later.

Hi Gaara1216,

Thanks for prompt reply.

There is a section in dependents form where my wife would need to write details about where I work and the dates I've been employed. Should I give details of my previous employer and the termination date when I was made redundant ?? Along with bit more explanation about the funds we have which are way more than 1800 ??

Also, regarding subsisting relationship, what would be the best way of proving it ??? We got married before two weeks and being Indians it was a marriage due to family introductions... Not sure who would I be able to prove it is real... any help would be great...

Just to be clear, my wife is planning to apply for visa and I am the one who was made redundant.

Dear All,

We are filling up application for my wife as Tier1 General Dependent, me being the Tier1 General holder.

one of the sections within online application called "Family Details" as below section on "Spouse/Partner", as seen in picture.

Could someone provide some guidance if this section would have name, passport and DOB details of the Dependent(the one applying on the form) or the Main Applicant(one who holds Tier1 Visa already) ??

The reason for this confusion is the fact that they have already asked the details of Dependent(the applicant) in first two sections, and they have asked details of Main Applicant(Tier1 Visa holder) in "main applicant" section before "additional Information" section.

Thanks in advance for any replies.
