Applying Spouse visa outside U.K

Post by nithinr98 » Mon Feb 10, 2014 1:49 pm

Hi all,

First of all thank you in advance for reading this. I'm settled in U.K on ILR visa. I legally wed my wife last september in India. The ceremonial wedding is in coming april. I did the legal wedding first so that i can get the marriage certificate and can apply for her visa so that after our ceremonial wedding she can fly back with me. i'm listing certain questions I'm having

1.Since the ceremonial wedding hasn't happened yet, we don't have wedding photos or invitation card to attach with the application. will this affect the application in any way?
2. I live in a 3 bedroom shared house to which my wife will be coming and my landlord is willing to give the no objection letter stating he has no objection in her joining the house. i don't have a Utility bill. is Utility bill necessary?
3. I fulfil the £18600 income threshold criteria. but my monthly income is not the same every month. it fluctuates depending on the overtime i do between £1600 and £1800 gross. so how can i let them know that i do make above £18600/year? i only need to provide 6 months payslip and my p60 for this year comes only in april and i need to apply before that.
4.what needs to be included in the no objection letter from landord and the employment letter from my employer?

once again, thanks a lot for going through this.
have a great day,
Rahul

hi
good luck with your plans

first of all your registered marriage is a legally recognised matrimony in India the place where it took place so it the marriage certificate should be enough. there are many people who do not get married in any religious ceremony .. you must have taken ample and plenty photos of that wedding surely..
the ECO will want to see that your marriage has social depth ie lots of relatives ?
you dont have to have invitation cards to prove your marriage is genuine. at the end of the day the ECO has to be convinced that your relationship is genuine and continuing from whatever evidence that you put in the application.
you live in a 3 bedroom house ?..ok.. yes but the point is how many people live there ? is it over crowded as defined by law ? if its over crowded then it is no good.
the fact that the land lord is prepared to write a letter of no objection is a necessary but not a sufficient condition.. you have to get a certificate from the council ( £ 75 ) that will be a must in your case.

you say you are making more than 18600 then your six months pay slips will prove that so i think you will be fine there...but make sure it is all there... they will fail the whole application even if there is a penny short...

The employer letter MUST contain the word GROSS salary....and not annual salary...otherwise the application will be rejected even if you earn LOT LOT more than 18 600.

Feel free to ask q and tell us your experiences and tips good ideas
what worked for you etc... so we can all learn and help each other.
dont forget to do your time line...

hi.. thanks for taking time for the reply. how can i get this certificate from council? what is it called? what are the procedures? 3 people(including myself) live in the 3 bedroom house at the moment.
also iam not sure how should i calculate my annual salary to write it in the column asking for annual salary? like i said, it varies each month. and my p60 for this year only comes by april and i need to apply this month itself

thank you
