My husband applied for spouse visa last year 7/01/2012 and he was refused in March 2012
This was because the ECO thought we failed to disclose that he had over stayed in the UK and that he had been 'encountered' by the UKBA and was sent back to his country. Previously he was to marry someone else in the UK. So they believed he did marry her. They didn't believe our marriage is genuine or that we plan to live together in the UK.
Now my court hearing is next Monday InshAllah.
In court i have proof he was not 'encountered' but actually contacted the UKBA himself and voluntarily left the UK. He signed a voluntarily paper IS101 before he left the UK and paid for his own ticket which had been booked before he contacted the UKBA.
In the application we did write when he entered the UK and we wrote his previous home office reference number which would have shown he had overstayed.
I have proof from the main General Register office that has proof of everyone that has married in the UK. It shows he never married his ex.
As for our relationship we have pictures and tickets of our honeymoon to Goa. Flight tickets and hotel receipts and pictures of our meet up in Dubai and then my latest visit to his country for our 1 year anniversary. I have WhatsApp conversations of the whole of last year. Skype records from before marriage to now and Facebook records.
Will this be enough? As you can imagine i am getting very anxious as the court date is getting closer. People are telling me all these negative stuff.
I have every point in my refusal covered InshAllah
To show my relationship is genuine is all the proof i have enough?
Since my marriage to my husband i have visited him twice and have all proof of it.
