FLR(O) when to apply

Post by kaeliathane » Tue Mar 04, 2014 5:11 pm

Hello,

Three years ago I applied for an unmarried partner visa, but accidentally applied a few days late, and thusly was given discretionary leave to remain.

I'm applying to extend this via for FLR(O) and I'm finding conflicting information about when to apply. In the form's guidance notes, they simply say to apply before the end of my current visa. But elsewhere I've seen advice that I must apply 28 days before the end of my stay. To make it more confusing, I've also seen advice that I must apply WITHIN 28 days of the end of my stay. Could someone please clarify for me when I actually need to send in the application?

Thanks very much for your help.

From 28 days before, until the date of expiry. I assume you never had FLR(M)? How long have you been in the UK?

Thanks Amber,

So, as the 17th of March is 28 days before the date of expiry, I should not apply before the 17th?

No, I applied for and unmarried partner visa and was given discretionary leave to remain instead. I've been here for 8 years now.

Yes, the dates appear right.

You may be able to settle 1 year earlier, in 2 years time under SET(LR).
