A8 nationals and permanent settlement under the 2006 Regs

Can A8 nationals who joined the EU on 1st May 2004 rely on Reg 15 of the 2006 Regs and make an application for permanent settlement? I can't see any distinction drawn btwn A8 and 'old' EU citizens in this regard or am I wrong?!

A couple of provisos here. Firstly, until new regulations came into force on 30.04.06, all time in the UK by the A8 national could be counted. For example a Polish citizen who arrived in the UK on say 01.01.02 could have applied for PR as from 01.01.06 (there then being a 4-year qualifying period).

However once the new EU regulations came into force on 30.04.06 for A8 nationals it is no longer possible to count the pre-01.05.04 time in the UK. Accordingly if the say Polish citizen arrived in the UK on 01.01.03 then effectively the time in the UK pre-01.05.04 does not count, and therefore it is not until 01.05.09 that they will get their PR.
