
I just want to ask about the refusal we received dated 7 April 2014.
My mother and sister has been coming to UK as a family visitor visa and had no problems applying it till their 3rd time application. They been here in Sept 2009 to Feb 2010 and recently 11 April 2013 to 5 Sept 2013. Both has been a short- term 6 months visa application
In their 3rd time, we again applied for 6months short term visa dated for 11 April 2014 to 11 Oct 2014. In this occasion, they had been refused as according to the refusal letter:
If I were to issue you a visa you would have spent nearly 11 months in the UK over a period a period of 18 months (April 2013 - October 2014) which means that you will have made UK your de facto home which is not permitted under paragraph 41(ii) of the UK Immigration rules; intends to leave the UK at the end of the period of the visit as stated by him; and does not intend to live for extended periods in the UK through frequent or successive visits.
I have therefore refused your application because I am not satisfied on the balance of probabilities that you meet all of the requirements of the relevant Paragraph of the UK Immigration rules.
Just a quick background: I am British Citizen now and have 3 children. The latest was born a day before my mother left last time. During their visit here, they only stayed for 5 months and genuinely a visitor here. I needed my mother to give me emotional support especially last time as my pregnancy was complicated. I was gutted that they were refused this time as I wanted my mother to be here in the UK as they left me a day after I gave birth and again wanted her to be with me more for emotional support with the growing kids. We do not intend for them to make UK as their home but my mother is already in her 60's and all her grandchildren are here in the UK. We have no intention of coming home for holiday at the moment due to work circumstances.
We are thinking of reapplying in May but this time on a Long term visa such as 2 years with planned travel on 1 June 2014 to 1 Dec 2014. What are our chances this time? And how can we make our application much solid to be granted a visa.
