UKBA success of minimum income

In the event of recent UKBA success of minimum income threshold what will be best course of action to do for those who don’t meet the minimum income threshold.

As I am applying next month my SET (LR) and hoping FLR (M) for my spouse (she is my PBS dependent since Nov 2010), but my income is below than £ 18600.

• Will our FLR (M) be refused straight away? And she will be forced to go back?
• Or should I use any other form like FLR (FP) (for the time being)

Or any other way around this situation?

• I have a son born here last year though he has a dependent visa; should I skip him from my ILR application or do I have to mention him in my SET (LR) with set income / maintenance as well?

You dont need to add your son. Because he was born here you can register him as british citizen when you get your indefinite. For your wife is she working? If she does both of you can use your income. If not then you can use the PF route. You mentioned she is PBS dependent.. if it is work permit (tier1,2 not post study work) then the requirement does not apply to you because there was a transitional arrangement for those whose partners were here in such category before the law was introduced on 9th July 2012.

Well she does has income as she teach online to student abroad, we never thought of that income, but I recently registered her in HMRC for taxes and proof of income. Her first tax returns / self assessment will be next year as sole trader / self employed, therefore we don't have any other sources to prove her income to add-up mine.

And I have no idea what to do now. As these rules kick in April and we applying in August, so I can't even produce her 6 months income.

And no don't have much savings too.

You mentioned she is PBS dependent.. if it is work permit (tier1,2 not post study work) then the requirement does not apply to you because there was a transitional arrangement for those whose partners were here in such category before the law was introduced on 9th July 2012.

Well she was Tier 4 Dep and now Tier 1 (PSW) dep
