7 years children policy

hi everyone, we came here on student visa, and after two consecutive extension my husband applied for psw but unfortunately documents used was fake, and refused under 320.
as we came here with kids as well and they r going school when they came here, what are the chances under children seven years policy , we discuss with different solicitor and they asking, u can apply but only kids with mother, and once they got visa then husband can apply.....
is there any case which is same and issued visa already, or any advice
