Hi thanks for reading my post, I was a student at Manchester University for a graduation studies but I had some financial difficulties I only studied for first year at University, I sent my visa for extension in March 2011 but they sent me back in June kuz i didn't had enough money for extension, they said re apply visa, but i had a fear of rejection so i didn't re apply. now i am a over stayer ... my wife is British born actually we had a Muslim marriage (NIKKAH) in 2011 n since than we are living together, well we've known each other for almost years, we have sent phone bills, Joint account, pictures of nikkah n wedding to HO, joint statements her salary slips, utilized bills etc
ps my wife is on 27k per annum.
We Applied a Visa via solicitor on 1st week of July 2012
Acknowledgement received on 19th of July 2012
sent my English language test on 25th of July 2012
Biomtric letter on 17th Sept 2012
Biometric sent on 23rd Sept 2012
And than Home Office has refused under paragraph 286 with reference to paragraph 284 (I) and paragraph 284 (IV) and I have no right to appeal. But than this October God blessed me with a Baby boy now we have his birth certificate and NHS documents. so I need to know its best to go back pakistan and re apply visa ? coz I wasted so much time and I want to get my visa asap as my father isn't well so I can go and see him. It will be really helpful if you tell me how long the whole case will take, if takes more than 4 months than I will prefer to doing it from Pakistan.

Always easier to apply from home - start process again all legal and proper and no more looking over your shoulder.

I'd say get your application together.

Make sure all the papers are ready, shouldn't take more than a week or so, then go to Pakistan, get all the paperwork that needs to be done there done (TB Test, English test etc)

Then get the date fixed and be ready to sit about in Pakistan for the best part of a year.

The only material thing that needs to be weighed up by the ECO is the minimum income requirement.

If you're in Pakistan and your wife meets the income requirement then you're in the door inshalah!
