US Citizen (Wife) to get UK Spouse visa after Immigration Of

Hello,

To begin I met my wife online in 2008, then I got a visa to work and holiday in new york for 4 months in 2010 where I met her and spent time with her.

Then we decided we would go to Bangladesh to our hone country and get married under Bangladesh law in summer 2014.

We came back together to the UK from Bangladesh and she told the immigration office she was visiting family and that she will be staying with them, but in actual fact she would be staying with me and getting married here.

Our registry in the uk gets intervened by the UKVI and they tel her she has to leave on her own expense on the next flight and until her flight date is here, she has to sign in at the local office.

Now I want her to go back and reapply the way we should have, and try to get a spouse visa for her. We qualify on every criteria, but what are the chances with this immigration offence?

She also told the whole truth to the officers that took her in and showed remorse, she's a really fearful person and was a giant mistake on both of our parts to even go ahead with such a thing.

I mean if I could get an honest opinion or even experience from someone, it would be a great help.

Hello, was wondering if there were anymore thoughts or info on this?

Have there been any cases where someone has been in a similar situation and has had a visa approved?

The best you can do is to apply for fiancee visa and see how it goes from there,if you eventually get the visa,that will definitely cancel out any challenge you might have when you apply for the marriage visa.
At least you'll know where you stand than looking for experience of someone. May be you came across this forum before doing it your own way,I don't know.

Explain it in the additional information that it was an honest mistake, except you knew you planned it though.

Thank you very much for that. It was like a two part mistake, yes we didn't know we didn't need to get married here again and also we did intentionally have her enter to get married at registry. A stupid mistake like that has lengthened the time and headache we need to go through to get to the final destination which is a spouse visa.

BTW I had a tourist visa sent in for her to see if she would be allowed to visit before I am in a position to apply for her spouse visa, they denied it. I have the paperwork and they put a stamp in her passport which references that refusal.

I spoke to a local immigration lawyer about it he goes all that refusal stuff isn't relevant at the time of spousal application, as spousal application is based on ME and HER (and my British rights to marry anyone), whereas the tourist one is based on solely if she has the intention to return (this would be ruled out on a spouse visa as the whole purpose is NOT to return).

So let's see how it works out.
